Idaho voters rejected House Joint Resolution 4 (HJR 4) in the November 3, 2026, election. The proposed amendment would have given state lawmakers exclusive power to legalize marijuana and other psychoactive substances.
According to the Idaho Secretary of State's unofficial election results, about 66% of voters opposed the measure, while roughly 34% supported it.
The decision allows Idaho residents to continue proposing medical and recreational marijuana laws through statewide ballot initiatives. However, the vote does not legalize cannabis, which remains illegal under Idaho law.
HJR 4 would have changed Idaho's Constitution to prevent voters from using ballot initiatives to legalize marijuana and certain other drugs.
Supporters argued that drug policy decisions should remain with state lawmakers. Some also raised concerns about outside groups funding marijuana legalization campaigns.
Opponents viewed the proposal as a threat to voters' rights. They argued that Idaho residents should retain the ability to propose laws directly, including those involving marijuana.
Reclaim Idaho, a group that opposed the amendment, said its outreach found opposition among Republicans, Democrats, and independent voters.
The rejection of HJR 4 keeps the door open for future marijuana legalization efforts. Residents can still collect signatures to place proposed cannabis laws on the ballot under Idaho's initiative filing requirements.
A separate effort to legalize medical marijuana in 2026 failed to qualify for the election. The proposed Idaho Medical Cannabis Act did not meet the state's signature requirements.
For now, medical and recreational marijuana remain illegal in Idaho. The election does not permit cannabis possession, cultivation, or sales under the state's existing marijuana laws.
Future legalization efforts would still need to meet Idaho's ballot requirements and gain voter approval.
The Idaho State Board of Canvassers is scheduled to certify the election results on November 24, 2026, according to the state's 2026 election calendar.
