Kind Idaho, a cannabis advocacy group, has submitted a ballot initiative aimed at legalizing personal use and home cultivation of marijuana, targeting the 2026 Idaho election ballot. The proposal would legalize the personal possession of up to one ounce of cannabis or 1,000 milligrams of THC in products like oils and edibles and allow home cultivation of up to 12 plants. However, it explicitly prohibits public use and commercial cannabis sales. To qualify for the ballot, organizers must gather approximately 70,000 valid signatures by April 2026. The initiative adheres to Idaho marijuana laws and incorporates feedback from state officials to streamline the proposal.
The measure represents a strategic pivot for Kind Idaho, transitioning from previous medical marijuana campaigns to a non-commercial marijuana legalization approach aimed at reducing arrests and aligning with residents’ preferences. Many Idahoans currently travel to neighboring states with legal cannabis markets, spending an estimated $4.5 million weekly at border dispensaries. Decriminalization would allow them to possess and cultivate cannabis at home without violating Idaho’s drug possession laws.
Although the proposal excludes a regulated cannabis market and tax revenues, its passage could influence Idaho's cannabis policy landscape and the broader regional economy. Neighboring states may see a decline in cross-border sales if Idaho residents no longer need to purchase cannabis out of state.
